Terms and conditions of sale

Any purchase of items on the PLANET KIDS e-commerce site is subject to the present General Terms and Conditions of Sale (“GTCS”) which the Buyer declares to accept without reservation. They are in force since January 1, 2022.  

Âme d’enfance is registered with the Banque Carrefour des Entreprises (BCE) under number BE0764.895.280 and is not subject to VAT. The registered office is located at Grote Geeststraat 10, 1933 Sterrebeek.

Control

The Buyer places an order on the PLANET KIDS website by following the procedure indicated. PLANET KIDS’ automatic recording systems are considered as proof of the nature, content and date of the order.

The confirmation of the online order constitutes an electronic signature which has, between PLANET KIDS and the Buyer, the same legal value as a handwritten signature.

The sale will not be concluded until PLANET KIDS has confirmed the order.

This confirmation includes: a summary of the order; if applicable, an invoice for payment, subject to acceptance of the bank transaction by the Buyer’s bank.

PLANET KIDS reserves the right not to confirm an order for any reason. It is also possible that registrations have reached the limit of available places.

Right of withdrawal

In case of cancellation, the sum of 25% of the total amount of the order will be kept by PLANET KIDS, to compensate for the administrative costs incurred by an order.

PLANET KIDS will refund the customer using the same method of payment used by the customer to place the order. The refund will be made with deduction of the administrative costs. The refund will be made within 14 days after PLANET KIDS has been informed of the customer’s retraction request.

Price

Prices are indicated in euros and are valid only on the date the order is placed. PLANET KIDS reserves the right to modify prices at any time. Only the price displayed on the PLANET KIDS website is binding between the parties.

Payment methods

To pay for his order, the Buyer has the methods of payment indicated at the time of placing the order.

Online payment enables the Buyer to pay for his order via the MOBILE payment platform, in a secure environment (https protocol and encryption key).

PLANET KIDS reserves the right to cancel or suspend any order in case of refusal to authorize payment by credit card by the Buyer’s bank or in case of an existing commercial dispute with the Buyer.

Personal data

The Buyer’s personal data is processed in accordance with the law of December 8, 1992 on the protection of privacy with regard to the processing of personal data. Our policy is explained in the “legal notices” tab.

Compliance

The Buyer acknowledges that he/she has consulted all information relating to the item prior to purchase and that the item conforms in all respects to his/her request.

The photographs illustrating the online catalog are not contractual and may be modified at any time. PLANET KIDS cannot be held responsible for non-conforming and/or erroneous photographs.

Contractual amendment

Any modification of the GCS is enforceable against the Buyer within 72 hours of their publication online.

Liability

The Buyer is informed that the liability of PLANET KIDS, whatever the nature of the loss, shall in any event be limited to the amount of the order.

In case of non-performance, PLANET KIDS shall not be held liable if the non-performance of the sales contract or its improper performance is attributable either to the Buyer, or to the unforeseeable and insurmountable act of a third party unrelated to the sale, or to a case of force majeure.

Furthermore, PLANET KIDS cannot be held responsible for any direct or indirect damage resulting from the use of the item sold.

PLANET KIDS is in no way responsible for interruptions in access to its site and the consequences that may result.

PLANET KIDS can never be held responsible for any temporary or permanent damage or incident that may be caused to the user’s data or computer equipment when accessing the site or visiting its pages, or generally when the files and software that make up the site are transmitted to the user’s receiving device. In particular, PLANET KIDS is not responsible for the possible transmission of viruses through its site.

PLANET KIDS is not responsible for the fraudulent use of its means of distribution and declines all responsibility in the event of intrusion into its computer systems and theft of data, it being understood that PLANET KIDS implements the necessary means to prevent such illicit intrusions.

Web spaces outside the domain of https://www.planetkids.be and, in particular, spaces to which the user may be directed by means of hypertext links are the sole responsibility of the owners of these web spaces.

Intellectual property

All elements of the PLANET KIDS site, and in particular literary, graphic, phonographic, photographic and electronic data, are the property of PLANET KIDS asbl or its partners and are protected by intellectual property rights.

Any act of reproduction or transmission, outside the exceptions recognized by law, and without the express written consent of PLANET KIDS, is prohibited and liable to civil and criminal penalties for counterfeiting. In application of the law of August 31, 1998 concerning the protection of databases, any extraction of a qualitative or quantitative part of the contents of the PLANET KIDS online catalog is illegal.

Proof agreement

The computer logs processed by PLANET KIDS’ computer systems are considered as valid proof between the parties (proof of orders, electronic communications, payments, etc.).

Indivisibility

If any provision of the GTC is invalidated for any reason, the parties agree that the remaining provisions shall remain in full force and effect.

Claims

All complaints must be sent by e-mail to the following address noam@letsport.be and include the references of the item concerned and the precise reasons for the complaint.

Applicable law and competent courts

In the event of a dispute concerning the application of the present terms and conditions, PLANET KIDS and the Buyer agree to apply Belgian law and give jurisdiction to the courts of the judicial district of Brussels.
